"Discussion question for fiqh nerds:
Maxim 1: "الضَّرُورِيَّاتُ تُبِيحُ الْمَحْظُورَاتِ"
Maxim 2: "الرُّخَصُ لَا تُنَاطُ بِالْمَعَاصِي"
Apply these two maxims to the following scenario:
Ahmed orders pork dumplings & wine.
A dumpling gets lodged in his throat.
Nothing else is available.
Can he use the wine to dislodge it? Why?

""fiqh before feelz" maxim 2 applies :) necessity in the first maxim is created by the man itself who ordered haram. therefore there is really no appropriate context of applying maxim 1."

الأشباه والنظائر للسيوطي (ص: 138)
قَالَ الْقَفَّالُ فِي شَرْحِ التَّلْخِيصِ ; فَإِنْ قِيلَ: كَيْفَ حَرَّمْتُمْ أَكْلَ الْمَيْتَةِ عَلَى الْعَاصِي بِسَفَرِهِ مَعَ أَنَّهُ مُبَاحٌ لِلْحَاضِرِ فِي حَالِ الضَّرُورَةِ، وَكَذَا مَنْ بِهِ مَرَضٌ يَجُوزُ لَهُ التَّيَمُّمُ فِي الْحَضَرِ؟ فَالْجَوَّابُ: أَنَّ ذَلِكَ وَإِنْ كَانَ مُبَاحًا فِي الْحَضَرِ عِنْدَ الضَّرُورَةِ لَكِنَّ سَفَرَهُ سَبَبٌ لِهَذِهِ الضَّرُورَة، وَهُوَ مَعْصِيَةٌ، فَحُرِّمَتْ عَلَيْهِ الْمَيْتَةُ فِي الضَّرُورَة، كَمَا لَوْ سَافَرَ لِقَطْعِ الطَّرِيقِ

فَجُرِحَ لَا يَجُوزُ لَهُ التَّيَمُّمُ لِذَلِكَ الْجُرْح، مَعَ أَنَّ الْحَاضِرَ الْجَرِيحَ يَجُوزُ لَهُ.
فَإِنْ قِيلَ: تَحْرِيمُ الْمَيْتَةِ وَالتَّيَمُّمِ يُؤَدِّي إلَى الْهَلَاكِ
فَالْجَوَابُ: أَنَّهُ قَادِرٌ عَلَى اسْتِبَاحَتِهِ بِالتَّوْبَةِ، انْتَهَى."
